A disciplinary procedure is the formal route an employer follows when an employee's conduct or performance is unacceptable. It sets out stages — typically investigation, hearing, decision and appeal — designed to be fair and consistent.
Fair process is not just ethical; it is a legal safeguard. Following clear steps, giving the employee notice and the right to be accompanied, and allowing an appeal all reduce the risk of successful dismissal claims.
Sanctions should be proportionate, escalating from a warning to dismissal only where justified, and every step should be documented.
