1.Trial Period and Access
BambooHR may offer you a free trial of the Services for a limited period (the "Trial Period") as specified during sign-up. During the Trial Period, you have access to the Services subject to these Free Trial Terms, the Acceptable Use Policy, and the Privacy Policy. These terms govern your use of the Services during any Trial Period.
Your Trial Period begins on the date you activate your trial account and ends on the date specified during sign-up, or when BambooHR terminates the trial at its sole discretion, whichever comes first. BambooHR may extend or shorten the Trial Period with advance notice.
2.Trial Limitations
During the Trial Period, BambooHR may limit the number of Authorized Users, the amount of data you can store, the features available to you, or other aspects of the Services. BambooHR may change trial limitations at any time without notice.
You may not use a trial account to (a) conduct load or stress testing; (b) mine data or gather benchmark information to share publicly; or (c) create more than one trial account without BambooHR's prior written approval.
3.Data During Trial
You may choose to import or enter data into the Services during the Trial Period. BambooHR recommends that you do not enter sensitive personal data into a trial account unless you intend to convert to a paid subscription. You acknowledge that trial accounts may be subject to lower security and availability standards than paid accounts.
Upon expiration or termination of the Trial Period, BambooHR may delete all data associated with your trial account. BambooHR shall have no liability for deletion of trial account data. If you wish to retain your data, you must either export it or convert to a paid subscription before the Trial Period ends.
4.Conversion to Paid Subscription
If you elect to convert your trial account to a paid subscription prior to the expiration of the Trial Period, your Customer Terms of Service will govern your use of the Services from the conversion date. You may retain data entered during the Trial Period subject to the terms of your paid subscription.
If you do not convert to a paid subscription before the Trial Period expires, your access to the Services will automatically end and any data stored in your trial account may be permanently deleted.
5.Trial Termination
BambooHR reserves the right to terminate your Trial Period at any time, for any reason, with or without notice. BambooHR shall not be liable to you or any third party for any termination of your trial account or deletion of trial data.
You may terminate your trial at any time by contacting BambooHR or by ceasing use of the Services. Trial accounts that are inactive for more than thirty (30) days may be automatically terminated.
6.No Warranties During Trial
THE SERVICES ARE PROVIDED DURING THE TRIAL PERIOD "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND. BAMBOOHR EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. BAMBOOHR DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE DURING THE TRIAL PERIOD.
TO THE FULLEST EXTENT PERMITTED BY LAW, BAMBOOHR WILL HAVE NO LIABILITY ARISING FROM YOUR USE OF THE SERVICES DURING THE TRIAL PERIOD. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES DURING THE TRIAL PERIOD IS TO STOP USING THEM.
