A workplace investigation is a formal, impartial process used to establish the facts around a complaint or allegation โ for example bullying, harassment, misconduct or a grievance. Its purpose is to gather evidence fairly so the employer can decide what, if any, action is warranted.
Fair procedure is central: the person complained about should know the allegations, have the chance to respond, and be entitled to representation, while witnesses are interviewed and evidence documented. Confidentiality and impartiality protect everyone involved.
In Ireland, investigations should follow the principles of natural justice and relevant WRC codes of practice; getting the process wrong can undermine any later disciplinary decision and expose the employer to claims. Clear terms of reference and careful record-keeping are essential.
